These terms and conditions cover all purchases from the Bucks Fireworks web site and cover purchases of both Fireworks and accessories sold on behalf of Bucks Fireworks Limited (‘BFL’) and Garden Machinery and accessories sold on behalf of Wexham Mowers Limited (‘WML’).

Governing Law and Contract Formation

Upon receipt of your order we will, as soon as is reasonably practicable, send you confirmation by e-mail. No contract for the supply of goods will subsist between you and BFL or WML until BFL or WML accepts your order by e-mail. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time BFL or WML send the e-mail to you (whether or not you receive that e-mail). For the avoidance of doubt, any such contract will be interpreted, construed and enforced, in accordance with English Law and will be deemed to have been concluded in England. Therefore, you and BFL or WML irrevocably submit to the jurisdiction of the English Courts.

BFL or WML and its agents have taken every care in the preparation of the content of this web site. To the extent permitted by applicable law, BFL or WML disclaims all warranties of any kind, express or implied, as to the accuracy of the information contained on this web site or the information, content, materials or products included in this site, including, without limitation, warranties of merchantability, satisfactory quality and fitness for a particular purpose. In addition, BFL or WML does not represent or warrant that the information accessible via this web site is accurate, complete or current. To the fullest extent permitted at Law BFL or WML shall not be liable for any loss or damage arising out of, or in connection with the use of this web site or the information, content, materials or products included on this web site. Age related restrictions

Please note that any orders for Fireworks must be made by a person over the age of 18. WE DO NOT SELL FIREWORKS TO THOSE UNDER THE AGE OF 18.

Security

If you decide to buy from BFL or WML, during the ordering process, you will be transferred to the SecPay secure payment site to enter your credit/debit card details. We will not be given your credit/debit card number. If you have any security concerns please do not hesitate to contact us. We recommend that you make all payments using the SecPay secure payment system. If you send us credit/debit card details using e-mail your details will not be encrypted and BFL or WML cannot be held responsible for the security of the information you provide.

Address details

Please take particular care with regards to entering your personal address information on SecPay.  If your house has a name and a number then it is imperative that both are entered when inputting your address.  Also, please take care to enter the post code correctly.  Your address details  MUST EXACTLY MATCH the billing address of your credit/debit card as recorded on your monthly statements.  Payment will be rejected if these details do not match.

Privacy

We will use the personal information that you provide only for the purpose of processing your order or enquiry. Details entered during the ordering process including your name, address, telephone number and e-mail address may be passed to SecPay as part of the payment process. SecPay will use this information together with your credit/debit card details for security and validation checks. Your name, address and telephone number will also be provided to our carriers to allow them to deliver your order. Where it is necessary to validate the warranty on your purchase we may complete and submit the registration details on your behalf. Typically, this would involve supplying your name, address, telephone number and details of the equipment purchased to the manufacturer of the equipment or the manufacturer's UK representative if the manufacturer is not UK based. Except as already mentioned, we will not provide your personal details to others.

Pricing

Prices are correct at the time of publishing and include VAT and delivery within the UK Mainland only. They are in United Kingdom pounds sterling.

BFL reserves the right to make substitutions if the item you have ordered is not in stock. We will replace the item with one of equal or higher value.

Product images are reproduced courtesy of the manufacturers/suppliers and copyright remains with them. Images are for illustration purposes only and the actual products may differ from the images shown. Please note that images are representative of the general style of the product and will be of the manufacturer but may not be of the exact model. Some images show accessories that may not be included in the price.

Faulty / defective goods (WML)

You can always return items to us if they are faulty or defective. Please note that we only accept returns of items that have been opened if they are faulty or defective. In the case of a fault or defective product, when returning an item please provide a full description of the fault and return the defective item to us in its original packaging together with all warranty documents, manuals and accessories. For your protection we would recommend that you use a Recorded Delivery Service and they must be returned to our contact address at your own cost and risk. We will refund the price you paid for such goods within 30 days of the date of cancellation provided that the goods are returned by you and received by us in the condition they were in, when delivered to you. Our Returns Policy does not affect your Statutory Rights.

Faulty / defective goods (BFL)

If any item fails then we will refund you 100% of the cost of that item. If an item fails please contact us and we will arrange to refund you. Please note that we will refund the credit card that you used to purchase the item. On occasions we may arrange for the firework to be collected from you so that we can analyse the fault to ensure this doesn't happen again.

Cancellation rights

You have the right under the Consumer Protection (Distance Selling) Regulation, to cancel your order within 7 working days, commencing from the day after the day you receive the goods. However, you must ensure that the goods remain unused and are retained in their original packaging unopened. You must return the goods within 15 days of the date of their delivery to you, to our contact address at your own cost and risk. We will refund the price you paid for such goods within 30 days of the date of cancellation provided that the goods are returned by you and received by us in the condition they were in, when delivered to you.

In the case of Fireworks, these CANNOT be sent back to us via Royal Mail or any standard courier. Please contact us if you wish to return a firework.

Shipping Costs

Shipping us currently FREE in the UK Mainland only. Please contact us if you do not live on the UK Mainland.

IMPORTANT NOTICE REGARDING DELIVERIES

It is your responsibility to let us know if there might be any access problems for vehicles delivering the products that you have ordered.  Particularly when lawn and garden tractors are ordered, lorries fitted with tail lifts will be used.  Narrow lanes, low or overhanging trees, narrow entrances or the lack of a turning area are all examples of possible access problems.  Any alternative or extra delivery arrangements that might need to be made will be at your cost.

Please note that for the purchase of Fireworks an person over the age of 18 MUST sign for the delivery.

Proof of delivery

A signature will be required on delivery as proof of delivery. The delivery person may ask for assistance in unloading the goods from his/her vehicle at the destination if he/she feels that such assistance is necessary for the safe delivery of the goods.

Instructions on filling the engine with oil must be followed

For safety in transit, petrol engines will be supplied "dry".  It is the customers responsibility to ensure that the engine is filled with the correct grade and quantity of engine oil, an adequate quantity of which will be supplied free of charge.  Please refer to the manufacturers operating instructions supplied with the product.

Warranty (WML)

All products advertised in this site carry a manufacturer's warranty. Any part or parts of the product that are considered by an authorised agent for the product to be defective in materials or workmanship or both will be replaced free of charge. The cost of transportation of the product to/from the authorised agent is borne by the purchaser. In some cases, most notably ride-on lawn tractors, the authorised agent can recover some transport costs from the manufacturer. Further details are available on request. The warranty periods shown are effective from the date of delivery and, unless otherwise permitted by the manufacturer, apply to the original owner only. The warranty periods shown assume use of the product in a "residential household situation" and that the product has been maintained in accordance with the instructions published by the manufacturers of the various components. A "residential household situation" excludes any use of the product for commercial operations, income producing or rental operations and racing/competition. Details of commercial use warranties are available on request. Only authorised agents can carry out warranty repairs. Details of your nearest agent are available on request. The warranty policy or policies covering a product will only cover defective materials and/or workmanship. Warranty will not cover the following :-

  • Normal wear and tear
  • Neglect, abuse and/or use of the product for a purpose for which it was not intended
  • Failures resulting from lack of or improper maintenance/adjustment
  • Failures caused by parts and/or accessories that are not genuine
  • Contamination caused by stale or dirty fuel
  • Failures resulting from insufficient lubrication
  • Routine maintenance and adjustment
  • Bent or broken crankshaft
  • Bent blade(s)
  • Failures caused by use of incorrect fuel
  • Expenses incurred whilst the product is out of use for warranty repairs

This list is not intended to be exhaustive. Batteries and gear boxes can have different warranty periods to the rest of the machine. Details are available on request. If you have any questions regarding warranties please do not hesitate to contact us.

IMPORTANT NOTE: Oil and Petrol

When returning any petrol powered product all oil and petrol MUST be drained from the engine before you release the goods to a carrier. This is for the safety of the carrier firm.
